Quick answer

Cardiff is in Wales, which shares the England & Wales legal system โ€” so personal injury law is the same as in England: a three-year limit under the Limitation Act 1980, and the Official Injury Claim portal with its whiplash tariff for many lower-value road injuries. What devolution changes is the NHS and local councils in Wales, not the injury law itself. If proceedings are needed, they are usually handled at the Cardiff Civil Justice Centre on Park Street. The city's NHS major trauma centre is the University Hospital of Wales (UHW) โ€” the first in Wales. We are an information service, not a law firm, and we are not based in Cardiff.

Cardiff (Caerdydd) is the capital of Wales and its largest city โ€” the seat of the Senedd, a thriving waterfront at Cardiff Bay, and a magnet for sport, conferences and shopping. With a large student population, major events at the Principality Stadium and a busy commuter network, accidents happen, and people understandably ask whether claiming in Wales is different. The short answer is that the law is the same as England, but some of the institutions are Welsh. This guide explains both. We are an independent information service, not a law firm, and we do not act on claims or sell leads.

Wales, devolution and the law

This is the key point for Cardiff. Wales is part of the single England & Wales legal jurisdiction, so personal injury law is identical to England: the same three-year time limit under the Limitation Act 1980, the same whiplash tariff and Official Injury Claim portal for lower-value road injuries, and the same Judicial College Guidelines for valuing injuries.

๐Ÿ’ก What devolution does (and doesn't) change

The Welsh Government runs NHS Wales and local government in Wales, so the hospital that treats you and the council responsible for a pavement are Welsh bodies. But devolution does not change the law of your injury claim, which remains England & Wales law. Our making a claim in Wales guide covers this in more depth.

How long you have to claim

The Limitation Act 1980 applies in Wales. You normally have three years from the accident, or from the "date of knowledge" when you realised a significant injury was someone's fault, to settle or issue proceedings. For a child the clock starts on their 18th birthday, and there is no limit while a person lacks mental capacity. The court can permit a late claim under section 33, but rarely does.

Accidents common across Cardiff

  • Road incidents. Cardiff's busy arterial roads, the city centre and event-day congestion around the Principality Stadium are a recurring source of road traffic injuries.
  • Workplace accidents. The public sector, services, construction, logistics and the media and creative industries generate accident at work claims.
  • City-centre and event slips and trips. Shopping arcades, stadium crowds, bars and offices produce slip, trip and fall and occupiers' liability claims.
  • Public highways. Potholes and defective pavements can give rise to claims against the Welsh highway authority under the Highways Act 1980.

Where to get medical help

Always put your health first โ€” and your treatment records will also support any claim. Cardiff's NHS major trauma centre is at the University Hospital of Wales (UHW), run by Cardiff and Vale University Health Board and the first major trauma centre in Wales, anchoring the South Wales Trauma Network. For less serious injuries, an NHS Wales urgent or minor injuries unit or your GP is the right first stop. Keep a note of when and where you were seen.

Accidents at work in the region

Cardiff's economy spans the public sector, financial and business services, construction, logistics and a strong media and creative cluster. If your employer was negligent or breached its health and safety duties, you may have a claim. Two reassurances: employers are legally required to hold employers' liability insurance, so a successful claim is paid by the insurer rather than a colleague or the business; and it is unlawful to dismiss you for bringing a genuine, reasonable claim. Report the accident in the workplace accident book, get medical attention, and keep evidence. The Health and Safety Executive (HSE) โ€” which operates across Great Britain, including Wales โ€” may investigate serious work accidents.

Finding a regulated solicitor (we are not one)

We are not a law firm and we are not based in Cardiff. We don't take on claims, sell leads or recommend specific firms. To find and verify a regulated solicitor, use the Law Society's "Find a Solicitor" service to identify an experienced personal injury practitioner, and check the firm or individual is authorised on the SRA register. You do not need a Cardiff-based or Welsh-speaking solicitor โ€” any SRA-regulated firm in England and Wales can act. For free, impartial help, Citizens Advice has offices across Cardiff and Wales.

Frequently asked questions

Is making an accident claim in Cardiff different from England?

The law is the same. Wales shares the England & Wales legal system, so personal injury law โ€” the Limitation Act 1980, the whiplash tariff, the Official Injury Claim portal and the Judicial College Guidelines โ€” applies in Cardiff exactly as it does in England. What is devolved to the Welsh Government is the NHS and local government, so the hospital that treats you and the council responsible for a pothole are Welsh bodies, but the legal rules of your claim are unchanged.

What is the time limit for an accident claim in Cardiff?

Generally three years from the accident, or from the date you knew it caused your injury, under the Limitation Act 1980, which applies across England and Wales. The limit runs from a child's 18th birthday, and there is no limit while a person lacks the mental capacity to claim. The court's section 33 power to allow a late claim is used only sparingly, so act in good time.

Where would my Cardiff claim be heard if it went to court?

If proceedings are needed, civil claims are generally handled at the Cardiff Civil Justice Centre at 2 Park Street, which is also the Cardiff District Registry of the High Court. In practice, most personal injury claims settle by negotiation with the at-fault party's insurer and never reach a hearing.

Do I have to use a Cardiff or Welsh solicitor?

No. Any solicitor regulated by the Solicitors Regulation Authority can handle a Cardiff claim wherever in England and Wales they are based, because the case is run remotely and governed by where the accident happened. A Welsh-speaking solicitor may be a personal preference, but it is not a legal requirement. Choose a firm for being SRA-regulated and experienced in personal injury.
